Honda Lawsuit Makes Claims of Defective Transmissions

A Honda Class Action Lawsuit has been filed against American Honda Motor Company, concerning defective transmissions installed in all model-year 2017-2019 Honda Odyssey Vehicles and all model-year 2014-2019 Honda Pilot vehicles, sold or leased, to consumers in California.

Per the complaint (featured below), these defective transmissions are: identical (or nearly-identical) in design and manufacturer, exhibit the same defects, and are subject to the same advisory from Honda that any “judder from the Torque Converter Lock-Up Clutch” is caused by “deteriorated transmission fluid,” which deteriorates quicker than expected when it is exposed to intermittent high heat loads under specific driving conditions.

These vehicles were sold or leased with a 36-month/36,000-mile express New Vehicle Basic Limited Warranty and a 60-month/60,000-mile express Powertrain Limited Warranty. These warranties are supposed to cover any repairs needed to correct defects in materials or workmanship, and, being that these transmission products are defective in their materials and workmanship, the warranties would specifically apply to these vehicles.

The defects cause sudden, unexpected shaking and violent jerking (referred to by Honda as “Juddering” and “Shuddering”) when drivers attempt to accelerate and shift the transmission into a higher gear. The transmissions also tend to hesitate before responding to a driver’s input on the accelerator pedal, which prevents the automobiles from gaining speed as the driver intends to do.

Similarly, these cars also tend to accelerate unexpectedly, or “surge,” while already in motion. The vehicles may also produce a hard downshift and “clunk” when decelerating.

All in all, these transmission defects create unreasonably dangerous situations in various driving conditions and increase the risk of a crash and/or injury. The juddering, shuddering, hesitating, surging, and hard clunking are all caused by the defective transmissions.

Did Honda Know About the Defective Transmissions?

According to the Honda Transmission Lawsuit, the company began selling the fourth generation of the Honda Odyssey in the State of California in 2010. Similarly, Honda began selling the third generation of the Honda Pilot in California in 2008. With these facts in mind, plaintiffs allege that by 2016, Honda should have been well aware, or were very much aware, of the defects present in the transmissions installed in the vehicles represented in this lawsuit before any of the cars were sold or leased in 2016.

In fact, as far back as 2012, Honda released a Technical Service Bulletin (TSB) to its authorized repair dealerships, advising that drivers of the 2011-2012 Odyssey were reporting judders, hesitation, and surging. At this point, Honda advised its mechanics and technicians to update the computer software of the transmissions or replace the transmission fluid in the affected vehicles.

Furthermore, in 2015, Honda released another TSB to its repair dealerships advising that drivers of 2014-2015 Odysseys were reporting hard downshifts and “clunks” while accelerating or decelerating and recommended another update of the computer software.

A full year later, in August of 2016, Honda released its third TSB expanding the scope of the affected Honda Odyssey vehicles to cover 2013 as well. This time, the automaker claimed that the defect came from deteriorated transmission fluid, resulting from “high heat load” under specific driving conditions.

Honda has only put forth temporary fixes to this issue thus far and consumers continue to complain about these safety defects. These transmission issues can cause serious accidents, resulting in serious injuries, for drivers and passengers alike, yet Honda continues to conceal this knowledge and has yet to disclose to the public these vehicles are defective and dangerous.
